Interpretation

• Application refers to Sailor, the software program provided by the Company.
• Company (referred to as either "the Company", "We", "Us" or "Our" in this Privacy Policy) refers to SAILOR COMPANY KUWAIT, Kuwait City.
• Country refers to: Kuwait.
• Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
• Listing means any item, ad, content or offer posted by a User through the Service.
• Personal Data (or "Personal Information") is any information that relates to an identified or identifiable individual.
• Service refers to the Application.
• Service Provider means any natural or legal person who processes the data on behalf of the Company.
• Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
• You means the individual accessing or using the Service.

Collecting and Using Your Personal Data

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. This may include, but is not limited to:

• Phone number
• Full name
• Photos uploaded as part of a Listing

Usage Data

Usage Data is collected automatically when using the Service. Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), the time and date of Your visit, the time spent on pages, unique device identifiers and other diagnostic data.

Information Collected While Using the Application

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission, pictures and other information from Your Device's camera and photo library.

Public visibility: Photos You upload as part of a Listing are publicly visible to all users browsing the Service. Do not upload photos containing sensitive or private information You do not wish to be seen publicly.

You can enable or disable access to Your camera and photo library at any time, through Your Device settings.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

• To provide and maintain Our Service, including to monitor the usage of the Service.
• To manage Your Account: to manage Your registration as a user of the Service.
• To enable user-to-user communication: so that buyers can contact sellers regarding their Listings.
• To contact You: by SMS or push notification regarding security updates, OTP verification codes, or administrative matters.
• To manage Your requests: to attend to and manage requests You make to Us.
• To protect the Service: against fraud, abuse, and unauthorised access.
• For business transfers: in connection with any merger, sale of assets, financing or acquisition.
• To comply with legal obligations under the laws of Kuwait or other applicable jurisdictions.

We may share Your Personal Data in the following situations:

• With Service Providers: cloud hosting providers, error tracking services, and SMS communication providers, in order to operate the Service.
• For business transfers: in connection with negotiations of any merger, sale, financing or acquisition.
• With other users: Listings are public; the seller's name and listing photos are visible to anyone using the Service.
• For legal reasons: if required to do so by law or in response to valid requests by public authorities.
• With Your consent: for any other purpose disclosed to You at the time consent is requested.

User Responsibilities and Listings

The Service is a marketplace platform that allows users to post Listings and contact each other. By using the Service, You acknowledge and agree to the following:

• You are solely responsible for the content, accuracy, legality and quality of any information, photos, descriptions, prices and other data You include in a Listing You post on the Service.
• Prohibited content: It is strictly forbidden to post Listings for items, services or content that are illegal under the laws of Kuwait, including but not limited to: alcohol, narcotics, firearms, counterfeit goods, stolen property, items that violate intellectual-property rights, content that violates public morality, or any other items prohibited by Kuwaiti law. Listings violating this rule will be removed without notice and the responsible Account may be suspended or terminated.
• Transactions between users: The Company is a platform provider only. The Company is not a party to any agreement, sale, transaction or arrangement that takes place between users of the Service, whether occurring through the Service or off-platform. The Company is not responsible for the conduct of users, the condition or authenticity of any goods or services exchanged, payment disputes, delivery, or any other aspect of the dealings between buyers and sellers.
• Your acknowledgement: You agree to deal with other users at Your own risk and to use Your own judgment when interacting, meeting, paying, or exchanging items with anyone You meet through the Service.
• Reporting violations: If You see a Listing that violates the rules above, please contact Us at the email address listed in the "Contact Us" section so We can review and remove it.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy, and to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements.

• Account information: retained for the duration of Your account relationship plus up to 24 months after account closure.
• Listings and photos: retained until the Listing is deleted by the user or the Account is closed; deleted Listings are removed from active storage within 30 days.
• Usage data and server logs: up to 24 months for security monitoring and service improvement.
• Throttling and rate-limit records: up to 90 days.

Where possible, We apply shorter retention periods and/or reduce identifiability by deleting, aggregating, or anonymizing data. Backup copies are deleted within a reasonable period consistent with our backup retention schedule.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and at the data centres of our Service Providers, which may be located outside of Your country of residence. Data protection laws in those jurisdictions may differ from those in Yours. The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

You may delete Your Account and the associated Personal Data at any time from within the Service by signing in and using the "Delete Account" feature in the account settings.

You may also contact Us using the email address below to request deletion. Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law Enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency in Kuwait or elsewhere).

Other Legal Requirements

The Company may disclose Your Personal Data in the good-faith belief that such action is necessary to:

• Comply with a legal obligation

• Prevent or investigate possible wrongdoing in connection with the Service

Security of Your Personal Data

The security of Your Personal Data is important to Us. We use industry- standard technical and organisational measures including encryption in transit (HTTPS/TLS), encryption at rest, row-level access controls, and authenticated-only access to private data. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and We cannot guarantee absolute security.

Age Restriction

The Service is intended only for individuals who are 21 years of age or older, in line with the legal age of majority in the State of Kuwait. By creating an Account, You represent and warrant that You are at least 21 years old.

We do not knowingly collect Personal Data from anyone under the age of 21. If You are a parent or guardian and You are aware that someone under 21 has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under 21 without verifiable consent, We will take steps to remove that information from Our servers.

Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third-party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third-party sites or services.

Governing Law

This Privacy Policy is governed by, and construed in accordance with, the laws of the State of Kuwait, including the Personal Data Privacy Protection Law (PDPPL) where applicable. Any dispute arising from this Privacy Policy shall be subject to the jurisdiction of the competent Kuwaiti courts.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date at the top.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
